These are the Terms and Conditions of tutor Amigo Limited, trading as Tutor Amigo. In this document, “we”, “our”, or “us” refer to Tutor Amigo Limited.
The Tutor Amigo Website is owned and operated by Tutor Amigo Limited, trading as Tutor Amigo. Tutor Amigo is a limited liability company registered in England and Wales under company number 12946692. Tutor Amigo’s registered office is at 71-75, Shelton Street, Covent Garden, London, WC2H 9JQ.

Introduction
Tutor Amigo aims to provide educated and talented people in developing countries a means of supporting themselves and their families and to provide children in the UK and beyond access to high quality educational tuition.
These terms and conditions (the ‘Terms and Conditions’) are effective from 1st November 2023 and replace any previous versions of them. Please ensure you read these Terms and Conditions in full before you agree to them.
When you create an account on our website, buy a product or service from us, or otherwise agree to our Terms and Conditions, a contract is formed between you and us.
The Tutor Amigo Website (‘the Website’) enables Tutor Amigo to act as an agent in the introduction of Clients to Tutors, Tutors to market their services to Clients, and for Clients to reserve and pay for Lessons. Tutor Amigo does not provide any tutoring services.
For each Lesson Reservation, Tutor Amigo collects a fee from the Client on behalf of the Tutor (the ‘Tutor Fee’) as well as a small fee associated with Tutor Amigo’s operational costs and commission for providing its agency services (‘Admin Fee’). The Lesson Charge is the combined fee collected from the Client for each Lesson and includes the Tutor’s Fee, the Admin Fee and, where applicable an appropriate rate of VAT.
A User is anyone who visits our Website. A Client is a User who is aged over 18 and reserves and pays for one or more Lessons on our Website or a User who is aged over 18 who reserves and pays for one or more Lessons on behalf of a User who is aged under 18. A Tutor is a User who markets their tutor services on our Website. Certain information from Clients and Tutors may be stored to facilitate any future visits to the Website by those Clients.
By using our Website, the User agrees to be legally bound by these Terms and Conditions. Any User who does not wish to be legally bound by these Terms and Conditions should not use the Tutor Amigo Website. Nothing in these Terms and Conditions affects a User’s statutory rights. Terms and Conditions
This contract uses certain key words and terms defined in these Terms and Conditions. Key words and terms are capitalised throughout this document.
Agreement Between Parties
This agreement is governed by the laws of England and Wales and the parties submit to the jurisdiction of the Courts of England and Wales. The User acknowledges that these terms govern the legal rights and obligations between them and Tutor Amigo.
Tutor Amigo reserves the right to alter these Terms and Conditions. No variation or alteration of these terms by the Client shall be valid unless expressly approved in writing by Tutor Amigo.

Tutor Amigo Undertakes to:
Introduce Clients to one or more of Tutor Amigo’s Tutors and provide a reservation service that allows Clients to request and pay for Lessons.
Endeavour to provide and maintain a functioning Website and a reservations service, although Tutor Amigo cannot guarantee that the Website will always be available or that it will always work as intended. On occasion it will be necessary to carry out maintenance on the Website. We endeavour to carry out such maintenance in a way which minimises any disruption to services as far as possible.
Endeavour to communicate to Users any planned maintenance of the Website or downtime whenever possible.
Use reasonable endeavours to check the identity of Tutors who appear on our website, including their academic credentials and their personal references.
Use its discretion to decide if a Tutor’s profile is sufficiently complete and of sufficiently high standard to appear on the Website and be accessible to Users of the Website.
Communicate new Reservation requests, confirmation of Reservations, cancellations of Reservations or amendments to Reservations, to both Clients and Tutors via the Website and/or by email.
Endeavour to ensure that a Client’s payment of a Lesson Charge and the payment of the associated a Tutor Fee are processed promptly within 30 days of receipt of payment via the Website whenever there is no Complaint or Failed Payment associated with that Lesson , in accordance with these Terms and Conditions.
Endeavour to ensure any Complaints are investigated promptly in accordance with these Terms and Conditions.
Endeavour to ensure that Refunds to Clients are made promptly and in accordance with these Terms and Conditions.
Take any precautions Tutor Amigo considers appropriate to protect Clients’ and Tutors’ information.
Monitor postings made on the Website in order to prevent or stop any misuse of the Website.

User Responsibilities
Users, including Clients, are responsible for their own security in conjunction with the services provided through the Website, both online and offline.
Users are at all times solely responsible for the material they post on the Website or communicate via the Website.
Users should report to Tutor Amigo any offensive or illegal material they find on the Website so that We can investigate and take appropriate steps to remove such material as soon as practicable.
Tutor Amigo provides its services on a best-efforts basis and cannot guarantee that all content on the website is up-to-date, complete or accurate. It is therefore the User who must exercise their own judgement and discretion regarding the accuracy of any and all information provided on the Website.
Users must keep their login and password details safe and confidential. Users must contact Tutor Amigo immediately if they believe their login credentials have been compromised or shared with unauthorised individuals or groups. Users will be responsible for all Reservations and communications made using the User’s credentials on the Website until they have notified Tutor Amigo that they believe their login credentials have been compromised.
Tutor Amigo aspires to use half its profits for charitable causes including supporting educational charities around the world. Our aim is to provide educated and talented people in developing countries a means of supporting themselves and their families and to provide children in the UK access to high quality educational tuition.
Users must not financially engage directly with Tutors outside of the Website. We reserve the right to cancel the account of any Tutor found to be trying to provide educational business away from the Tutor Amigo Website to an individual or group they have met through the Website.
Tutor Amigo reserves the right, in its sole discretion, to suspend from or remove access to the Website and any related services of any Tutor or User who fails to comply with these Terms and Conditions. In these circumstances Tutor Amigo reserves the right to cancel any existing Reservations and refund Clients for any future Lessons they have paid for but not yet received.
Client Responsibilities

How long we retain your data
Suggested text: If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.
For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.
What rights you have over your data
